The Rosenthal Fair Debt Collection Practices Act (RFDCPA) is the state of California’s own version of the Fair Debt Collection Practices Act (FDCPA). It extends many of the same protections afforded by the FDCPA, and also provides additional layers of protection to defend you from harmful actions of creditors.

Consumers who reside in the state of California are provided added protection. While the Federal Fair Debt Collection Practices Act applies only to debt collection agencies and not the original creditors, California law extends the protection to creditors as well. Also known as the Rosenthal Fair Debt Collection Practices Act, the law mirrors the Fair Debt Collection Practices Act and applies the act to creditors. Also, just like the FDCPA, the California state law also provides for statutory damages of at least $100 and up to $1,000, plus the award of reasonable attorney fees and costs.
