The Fair Debt Collection Practices Act (FDCPA) is a federal law that sets rules for how third-party debt collectors can contact and deal with consumers. It applies to consumer debts (like credit cards, medical bills, personal loans), not business debts.

What Does the FDCPA Say About Harassment?

One of the central protections under the FDCPA is the prohibition against harassment or abuse. Debt collectors can try to collect a valid debt, but they cannot cross the line into intimidation or deceit.

Here are examples of harassment and prohibited conduct under the FDCPA:

  • Excessive or repeated calls: Calling you multiple times a day to annoy or pressure you.

  • Calls at inconvenient times: Contacting you before 8 AM or after 9 PM, unless you agree otherwise.

  • Contacting you at work: If you tell them verbally or in writing that your employer doesn’t allow these calls, they must stop.

  • Threatening violence or harm: Any threat of physical harm is illegal.

  • Using obscene or profane language: They must remain professional.

  • Publicly disclosing your debt: They can’t tell neighbors, family, or co-workers about your debt, except to locate you (with strict limits).

  • Threatening legal action they can’t take: For example, threatening to arrest you or garnish wages when they don’t have that power.

  • Misrepresenting who they are: Pretending to be a lawyer or law enforcement officer when they’re not.

Your Right to Be Informed

The FDCPA doesn’t just protect you from harassment — it also gives you rights to understand the debt being collected.

Within five days of first contacting you, a debt collector must send you a written notice called a validation notice. This must include:

  • The amount of the debt.

  • The name of the original creditor.

  • A statement that you have the right to dispute the debt within 30 days.

  • Instructions on how to dispute the debt or request more information.

If you don’t think you owe the debt or believe the amount is wrong, you have the right to request debt validation. If you do so within 30 days, the collector must stop collecting until they provide verification.

When to Talk to a Lawyer

If you believe a collector has crossed the line — for example, by threatening arrest, cursing at you, contacting third parties, or ignoring your written dispute — talk to a consumer protection attorney. Many offer free consultations, and under the FDCPA, the collector pay your legal fees if you win. You may be entitled to statutory damages up to $1000.00.
