What debt collectors are allowed (and not allowed) to do to you
The activities of debt collectors are regulated by laws. They are not limitless or without boundaries. If a debt collector is beginning to make you uncomfortable, they are likely on the wrong side of the law. It is necessary to have the knowledge of these laws to enable you to know when a debt collector is violating your rights.
One of the laws that regulate debt collection practices is the Fair Debt Collection Practices Act. The FDCPA prohibits debt collectors from using any collection method that is unfair, abusive, or deceptive.
According to the FDCPA, debt collectors are allowed to do the following to you:
- Call you to discuss your debt
- Send you letters, messages, and emails about your debts
- Attempt to recover a debt that has exceeded its statute of limitations
- Contact your employer about overdue taxes and child support.
But debt collectors are not allowed to do the following to you:
- Call you many times a day with the intent of annoying and harassing you
- Call you at odd hours (before 8 am and after 9 pm)
- Tell any unauthorized third party (including family and friends) about your debt
- Call your workplace if they are aware that it is not allowed
- Threaten to harm you
- Threaten to sue you with no intention of doing so
- Threaten to send you to jail
- Threaten to seize your property
- Try to collect a debt that has been flagged “uncollectible”
