The statute of limitations for different states varies. It also varies depending on the type of debt involved. For instance, student loans and child support can never really be gotten rid of.
However, for other debts, generally, a debt collector cannot legally hold you over a debt if the debt is over 7 years.
This doesn’t mean that the debt collector will stop harassing you. They may continue to call and harass you even after the statute of limitations but they cannot sue you.
Many people are not aware of this, so they cower in fear when debt collectors harass them over old debts.
Having old unpaid debts will still have negative effects on your credit score but at least you do not have to put up with legal fees.
It is important to note that although a debt has exceeded its statute of limitations, it can actually be “revived”. Any form of acknowledgment of ownership you make during an ACI debt collection call can make the debt valid again. This means that the debt is now brand new and the clock has started ticking again.
This is why you must never admit to owning a debt when an ACI debt collector calls because it can be to your detriment.
Don’t admit to owing the debt, and don’t agree to pay over the phone. Instead, ask the ACI debt collector to send you everything in writing.
