Who is WayFair?

According to Wikipedia Wayfair is an American e-commerce company that sells home goods. Formerly known as CSN Stores, the company was founded in 2002 and now sells many home furnishings and décor items and over ten million products from over 10,000 suppliers.[2] Headquartered in Boston, Massachusetts,[3] Wayfair has offices and warehouses throughout the United States as well as in Canada, Germany, Ireland, and the United Kingdom.[4]

Wayfair operates six branded retail web sites: the main Wayfair site, Joss & Main, AllModern, Birch Lane, DwellStudio,and Perigold.

Robocalls From Wayfair-Stop The Calls!

There are several ways companies like Wayfair harass consumers and violate the law. The TCPA limits when and how often a company like Wayfair can call. The TCPA also bans the use of automatic dialing systems.  Some of the key parts that Wayfair must follow when making calls are below:

  • Companies must maintain a “Do Not Call” list and honor any request from a consumer to not be called again.
  • Marketers may not send unsolicited advertisements by auto-dialer, prerecorded voice message, or fax to anyone without prior express consent.
  • Customers must be able to opt-out of future robocalls during a robocall.
  • Calling without identifying themselves or without revealing the identity of the person or company on whose behalf they are making the calls

Facing harassment over your Wayfair credit card? Here are examples of some violations.

  • A debt collector trying to get you to make payment on your Comenity Wayfair card is not permitted to call you at an unreasonable time of day. Generally, the FDCPA prescribes that calls be made only within 8 am and 9 pm, except when you have stated otherwise.
  • Debt collectors may not cause your phone to ring repeatedly in an attempt to get you to pay your Wayfair credit card
  • Calls to your place of employment (especially after they have been duly informed that your employer prohibits such calls) is prohibited
  • A collector may not lie about who they are (saying that they are police or court officials, for example) in a bit to get you to pay your Wayfair Comenity bank debt sooner.
  • A debt collector is prohibited from threatening you with legal action that they cannot or do not plan to take action on.

If any of the above points sound familiar, you are being harassed by a debt collector, and it is important to get the name of person, along with the name of the company they collect for.  Write this information down, along with the date and time you received the call. It is also a good idea to keep records of exactly what the debt collector said to you, or to record the call. If the collector trying to coerce you into paying up your Comenity Wayfair card debt is found guilty of harassment, you are entitled to monetary compensation, alongside other benefits.

How to get a debt collector to stop contacting you over your Wayfair mastercard

Note that the law gives you the right to stop all communication from debt collectors. Take the steps outlined below if you no longer want to receive communication from debt collectors over your Wayfair credit card payment.

  • Let the collector know that you are aware of your rights
  • Over the phone, ask the collector to stop contacting you
  • While you still have them on the phone, ask for their name and address and inform them that you will be sending a written copy of your request to not be contacted further
  • Send the letter via certified mail, and request for a return receipt. This will serve as evidence that the debt collector received your letter.
  • You may ask that all further communication be directed to your attorney (if you have one) or simply request to cease communication.
