What to do when you’re not sure about a debt.

If you get a call from a collection agency talking about a debt that you do not recognize, the first thing you should do is to refrain from speaking too much; avoid saying anything that implies that you take responsibility for the debt. Listen as much as you can to the debt collector speak and if they try to use manipulative means to get you to reveal stuff to them, do not budge.

Ask them questions instead. The FDCPA mandates them to answer when you ask them for their name, address, company, and details about the debt. Take notes of these things when they answer and ask them to call you at a later time.

Next, you should go through your credit report and confirm if you actually owe the creditor they mentioned. If you are sure that the debt isn’t yours and the debt collector calls you again, ask then to send you proof that you owe (a debt validation letter). This request will likely send debt collection scammers away and make a mistaken debt collector realize his mistake.

However, if the debt collector fails to send you a debt validation letter and keeps calling you, you should write to the collection agency something called a “cease and desist letter” saying that you do not want them to call your phone again or future communication should be done through your attorney if you have one.
Any debt collector who fails to heed a cease and desist letter has violated the FDCPA and you can take legal action against them and get up to $1,000 in statutory damages.
