What If A Debt Collector Is Threatening Me?
Debt collection harassments come in various forms and threats are just one of them. A debt collector can get desperate and eager to get money from you, so much that they begin to threaten you. People in times past have complained about debt collectors threatening to sue them or send them to jail. Some debt collectors in rare cases go as far as threatening to bring physical harm to the debtor or their loved ones.
It is important that you know that any debt collector who makes threats is violating your consumer rights. The Fair Debt Collection Practices Act prohibits a debt collector from threatening their consumers. A debt collector who threatens to send you to jail is just trying to scare you. Being in debt is not a crime. Thus, no one unsanctioned by the court of law can send you to jail on that premise.
Also, debt collectors are not allowed to threaten you with a lawsuit if they’re not actually filing one. A debt collector who threatens to sue with no intention of doing so has violated the FDCPA.
If a debt collector is threatening you, this is what you should do
- Be calm: Do not get afraid, agitated, or frightened. Debt collectors could get very intimidating and almost make you break down. Don’t let this happen. Do not get angry too. You may be tempted to match a debt collector’s challenge by hurling abusive words back at them, but this will not help at all. Plus, it can be used against you eventually.
- Tell the debt collector that they are violating federal laws: You should let the debt collector know that you are aware of your rights and they are not respecting them. You may also warn them about the consequences and legal steps you may take against them if they fail to desist from making threats to you.
- Get evidence: Take recordings of the threats and save them. You may need them if you file a case in the future.
- File a lawsuit: If a debt collector refuses to stop making these threats, you have the right to sue them to court.
